CORvacations Terms of Service

These Terms of Service (“Terms”) form a binding legal agreement between you (“you,” “Guest,” or “User”) and CORvacations (“CORvacations,” “we,” “us,” or “our”) governing your access to and use of the CORvacations website — available at CORvacations.com and catalinaoceanresort.com, which are the same Platform — any related applications, and the services we provide (collectively, the “Platform”).
By creating an account or otherwise using the Platform, you agree to these Terms. If you do not agree, do not create an account or use the Platform.
Your use of the Platform is also subject to our Privacy Policy, which is incorporated by reference.
1. Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding contracts. By creating an account, you represent and warrant that you meet these requirements. The Platform is not intended for use by anyone under 18.
2. Account Registration and Security
To access certain features of the Platform (including making inquiries or bookings), you must create an account. You agree to:
- Provide accurate, current, and complete information during registration and keep it updated.
- Maintain the confidentiality of your login credentials and not share them with others.
- Accept full responsibility for all activity that occurs under your account.
- Notify us immediately of any unauthorized use or security breach.
You may maintain only one active account. We reserve the right to suspend or terminate accounts that violate these Terms, contain inaccurate information, or appear fraudulent.
Your account is personal to you. Only you may sign in and use your account, and only you may make bookings under it; you may not permit any other person to access or operate it. If you wish to make a booking on behalf of guests other than yourself, you may do so only with the prior approval of CORvacations or the Host, and you remain the party to the booking and fully responsible for it and for the conduct of the guests you book for.
3. Description of the Platform and Our Role
CORvacations operates an online Platform that allows users to discover, inquire about, and book vacation rental properties (primarily associated with Hamilton Cove and related Catalina Island properties, among others), and to discover and request experience services offered by independent local providers (see Section 7).
We act as a technology platform and facilitator. Unless we expressly state otherwise for a specific listing, CORvacations is not the owner, operator, or landlord of the properties listed. Bookings are agreements between you (the Guest) and the property owner or manager (“Host”). We do not control the Hosts, the condition of the properties, or the actions of other users.
4. Bookings, Payments, and Fees
When you make a booking, the total price is displayed before you confirm. It may include the rental rate, a cleaning fee, applicable taxes (including transient occupancy tax), a service fee, and a refundable security deposit. Each component is itemized at checkout.
Payments are processed by third-party payment processors. CORvacations does not store your full card number. By making a booking, you authorize the charge for the total shown, and — where a booking is payable in parts — the remaining balance on the schedule shown at checkout. You are responsible for any payment made through your account.
A booking is not confirmed until you receive confirmation through the Platform. Prices and availability may change until confirmation.
5. Cancellations and Refunds
Each booking is governed by the Cancellation Policy displayed for that listing at the time of booking. The version shown to you when you book is the version that applies to that booking, and it is preserved with your booking record. Refunds, where due, are returned to the payment method used and will never exceed the amount you have actually paid.
6. Security Deposits and Damage
Where a listing carries a refundable security deposit, it is returned to you in full after your stay unless there is damage to the property, missing items, or a violation of the House Rules that results in cost to the Host. If a deduction is proposed, we will notify you with a description of the claim. You agree to leave the property in substantially the condition you found it, ordinary wear excepted.
7. Experience Services and Third-Party Vendors
The Platform may let you discover and request services offered by independent local providers — for example spa treatments, transportation, tours, or equipment delivery (“Experience Services”). Providers of Experience Services (“Vendors”) are independent businesses. CORvacations is not the Vendor, does not provide the services, and does not control their availability, quality, or pricing.
When you request an Experience Service, your request is forwarded to the Vendor, who confirms whether they can fulfill it. Payment for Experience Services is arranged between you and the Vendor as described at the time of your request. Prices shown on the Platform for Experience Services are indicative and are confirmed by the Vendor before you pay. Any dispute regarding an Experience Service is between you and the Vendor, though we will assist where we reasonably can.
8. Hosts
If you list a property on the Platform, these Terms apply to you as a Host in addition to any separate agreement between you and CORvacations. As a Host you agree that:
- Your listing information is accurate and kept current.
- You hold the rights and permissions necessary to offer the property.
- The Cancellation Policy for your listing is selected from CORvacations’ published policies; you cannot write your own.
- Your House Rules are your own document: you are responsible for their content, and they will be presented to Guests as authored by you, not by CORvacations.
- Any document you upload to the Platform is yours, and CORvacations disclaims authorship of it.
9. Your Use of the Platform
You may use the Platform only for lawful personal purposes related to searching for, inquiring about, or booking vacation rentals and Experience Services. You agree to:
- Comply with all applicable laws and regulations.
- Provide truthful information in all communications and bookings.
- Respect the rights of Hosts, Vendors, and other users.
- Comply with any House Rules or property-specific requirements that apply once a booking is made (these will be provided or linked at the time of booking).
10. Privacy
Our collection and use of personal information is governed by our Privacy Policy. By creating an account, you acknowledge that you have read and understood the Privacy Policy.
11. Communications
By creating an account, you agree to receive transactional communications from us about your account, bookings, and stays — by email and, where you provide a phone number, by text message (SMS). These include booking confirmations, payment notices, check-in information, and stay-related documents. Message and data rates may apply. You can opt out of SMS by replying STOP, and out of non-essential email via the unsubscribe link; messages necessary to administer your account or an active booking may still be sent. We do not send marketing messages without a separate opt-in.
12. Prohibited Activities
You may not:
- Provide false, misleading, or incomplete information.
- Create multiple accounts or transfer your account.
- Use the Platform for any commercial purpose other than legitimate personal travel bookings without our prior written consent.
- Attempt to circumvent fees, security measures, or Platform processes.
- Harass, threaten, or harm other users, Hosts, or Vendors.
- Scrape, copy, or misuse content from the Platform.
- Engage in any activity that could damage, disable, or impair the Platform.
13. Your Content
You retain ownership of content you submit to the Platform — messages, photos, documents, and other material. By submitting it, you grant CORvacations a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit that content as needed to operate the Platform and provide the services (for example, delivering your message and its photos to a Host). You represent that you have the rights to the content you submit and that it does not violate the law or the rights of others. We may remove content that violates these Terms.
14. Intellectual Property
The Platform, including its design, text, graphics, logos, and software, is owned by CORvacations or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission. If you believe content on the Platform infringes your copyright, contact us through the contact form on the Platform with sufficient detail for us to identify and evaluate the claim.
15. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF LISTINGS, HOST OR VENDOR COMMUNICATIONS, OR PROPERTY OR SERVICE CONDITIONS. YOU USE THE PLATFORM AND ANY BOOKINGS OR EXPERIENCE SERVICES AT YOUR OWN RISK.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CORVACATIONS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, ANY BOOKING, OR ANY EXPERIENCE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
17. Indemnification
You agree to indemnify, defend, and hold harmless CORvacations and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Platform, your breach of these Terms, or your violation of any law or the rights of a third party.
18. Termination
We may suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including violation of these Terms. You may close your account at any time by contacting us. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will survive termination.
19. Changes to These Terms
We may update these Terms from time to time. Each revision carries a new version number and “Last Updated” date and is posted on the Platform. If we make material changes, you will be asked to review and accept the revised Terms the next time you sign in, before continuing to use your account. For changes that are not material (such as clarifications or corrections), your continued use of the Platform after the revised Terms are posted constitutes acceptance. Material changes may also be communicated by email or prominent notice.
20. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Platform shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.
21. Miscellaneous
- These Terms, together with the Privacy Policy, the Cancellation Policy applicable to your booking, any booking-specific confirmations, the House Rules for the property you book, and any additional property- or amenity-specific agreements presented to you at or after booking (for example, an agreement covering your use of a Host’s golf cart during your stay), constitute the entire agreement between you and CORvacations regarding the Platform.
- If any provision is found unenforceable, the remaining provisions will continue in full force.
- Our failure to enforce any right does not constitute a waiver.
- You may not assign these Terms without our prior written consent.
